IMPORTANT: BY USING DonnBoy, YOU ACKNOWLEDGE THAT ALL DUE DILIGENCE, BACKGROUND VERIFICATION, AND RISK ASSESSMENT BEFORE ENGAGING WITH ANY USER ON THIS PLATFORM IS YOUR SOLE RESPONSIBILITY. DonnBoy DOES NOT VERIFY USER IDENTITIES, CREDENTIALS, OR REPRESENTATIONS AND BEARS NO LIABILITY FOR ANY OUTCOME ARISING FROM CONNECTIONS MADE THROUGH THE APP.

1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the DonnBoy mobile application ("App"), website at DonnBoy.com, and all related services (collectively, the "Services") provided by DonnBoy ("Company", "we", "us", or "our").

By downloading, installing, registering, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must immediately cease using the App and delete your account.

These Terms constitute a legally binding agreement between you and DonnBoy & its parent Company (M/s Saulti TechWorks (OPC) Pvt Ltd.). We reserve the right to update or modify these Terms at any time. Continued use of the App after any changes constitutes your acceptance of the revised Terms.

2. Eligibility

You must meet all of the following criteria to use DonnBoy:

  • You must be at least 18 years of age
  • You must have the legal capacity to enter into a binding contract under applicable law
  • You must not be prohibited from using the App under the laws of your jurisdiction
  • You must not have a previously terminated DonnBoy account due to a violation of these Terms

By using the App, you represent and warrant that you meet all eligibility requirements. If we discover or have reason to believe that you do not meet these requirements, we reserve the right to suspend or terminate your account immediately and without notice.

3. User Categories and Platform Purpose

DonnBoy operates as a professional networking and talent discovery platform connecting two distinct categories of users:

Candidates: Individuals who create a profile showcasing their physical fitness, professional attributes, and availability for work opportunities. Candidates include but are not limited to bodybuilders, fitness models, gym professionals, and muscular individuals seeking professional engagements.

Viewers: Individuals, businesses, or organisations who use the platform to discover and connect with Candidates for legitimate professional purposes such as modelling assignments, brand endorsements, fitness demonstrations, event appearances, personal security, bouncer or other lawful commercial engagements.

DonnBoy is a professional networking platform only. It is not a matrimonial service, dating application, or escort service. Any use of the platform for purposes other than legitimate professional networking is strictly prohibited and may result in immediate account termination and legal action.

4. Due Diligence and User Responsibility

4.1 No Verification by DonnBoy

DonnBoy is a technology platform that facilitates connections between users. We do NOT:

  • Verify the identity, credentials, qualifications, or representations of any user
  • Conduct background checks, criminal record checks, or financial history checks on any user
  • Verify the accuracy of information provided in user profiles, including work experience, education, skills, or physical attributes
  • Verify the legitimacy, financial standing, or legal status of Viewers or their businesses
  • Endorse, recommend, or vouch for any Candidate or Viewer on the platform
  • Guarantee the availability, reliability, or suitability of any user for any purpose

4.2 Your Due Diligence Obligations

ALL DUE DILIGENCE BEFORE ENGAGING WITH ANY USER ON DonnBoy IS YOUR SOLE AND EXCLUSIVE RESPONSIBILITY. Before entering into any professional arrangement, agreement, or engagement with another user, you are solely responsible for:

  • Independently verifying the identity of the other party through government-issued identification or other reliable means.
  • Conducting your own background verification, including but not limited to criminal record checks, reference checks, and professional credential verification.
  • Assessing the financial credibility and legitimacy of any Viewer before accepting payment arrangements or entering into contracts.
  • Verifying the legal status, business registration, and reputation of any organisation or individual Viewer.
  • Assessing the physical fitness, skill level, and suitability of any Candidate for your specific requirements.
  • Obtaining appropriate legal advice before entering into any professional contract or financial arrangement.
  • Ensuring that any engagement you enter into complies with applicable labour laws, tax laws, and other regulations in your jurisdiction.

4.3 User-Submitted Reports

DonnBoy allows users to submit reports about other users including categories such as "Cheated Financially" and "Criminal Background". These reports are user-submitted and represent the subjective opinion or allegation of the reporting user only. DonnBoy does not:

  • Investigate, verify, or validate any user-submitted report.
  • Guarantee the accuracy, truthfulness, or completeness of any report.
  • Take responsibility for any decisions made by users based on the presence or absence of reports.

The presence of no reports against a user does NOT mean that the user has been cleared, verified, or approved by DonnBoy. The absence of reports should not be relied upon as confirmation of a user's trustworthiness or suitability.

4.4 Meeting in Person

If you choose to meet another user in person as a result of a connection made through DonnBoy, you do so entirely at your own risk. We strongly recommend:

  • Meeting for the first time in a public place.
  • Informing a trusted person of your whereabouts.
  • Not sharing sensitive personal or financial information before establishing trust.
  • Trusting your instincts — if something feels wrong, do not proceed.

DonnBoy bears no responsibility for anything that occurs during or as a result of an in-person meeting arranged through the platform.

5. Prohibited Conduct

You agree not to use DonnBoy for any of the following purposes, and understand that violation may result in immediate account termination, reporting to law enforcement, and civil or criminal liability:

5.1 Illegal Activities

  • Using the platform for any illegal purpose or in violation of any applicable local, national, or international law.
  • Soliciting, facilitating, or participating in human trafficking, exploitation, or coercion of any kind.
  • Using the platform for prostitution, escort services, or any form of sexual solicitation.
  • Engaging in fraudulent misrepresentation, identity theft, or financial fraud.
  • Money laundering or any other financial crime.

5.2 Harmful and Abusive Behaviour

  • Harassing, threatening, intimidating, stalking, or abusing any other user.
  • Uploading, sharing, or soliciting explicit, pornographic, or sexually suggestive content.
  • Targeting minors in any way or attempting to connect with individuals under 18.
  • Impersonating any person, business, or organisation.
  • Creating multiple accounts to evade a ban or restriction.

5.3 Platform Integrity

  • Attempting to scrape, crawl, or systematically extract user data from the platform.
  • Reverse engineering, decompiling, or attempting to access the source code of the App.
  • Interfering with or disrupting the App's servers, networks, or infrastructure.
  • Circumventing any rate limits, security measures, or access controls.
  • Using automated bots, scripts, or tools to interact with the App.
  • Submitting false, misleading, or malicious reports against other users.

6. User Content and Intellectual Property

6.1 Your Content

You retain ownership of all content you upload to DonnBoy, including profile photographs, gallery images, and personal information. By uploading content to the App, you grant DonnBoy a non-exclusive, royalty-free, worldwide licence to store, display, and serve that content solely for the purpose of operating the platform and providing the Services to you and other users.

You represent and warrant that:

  • You own or have the necessary rights to all content you upload.
  • Your content does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.
  • Your content does not contain material that is illegal, defamatory, obscene, or otherwise objectionable.

6.2 Content Moderation

All uploaded images are automatically screened by AI system. We reserve the right to remove any content that violates these Terms or our content policies without notice. Repeated violations may result in permanent account suspension.

6.3 DonnBoy Intellectual Property

All intellectual property rights in the App, including but not limited to the DonnBoy name, logo, design, software, algorithms, and proprietary profile scoring system ("Profile Hit Rate"), are owned by DonnBoy. Nothing in these Terms grants you any right to use our intellectual property without our express written permission.

7. Ratings and Profile Scoring

DonnBoy includes a rating system that allows Viewers to rate Candidates on a four-tier scale (Excellent, Good, Average, Poor). These ratings are aggregated to generate a "Profile Hit Rate" score using a proprietary algorithm. By using the rating system, you agree to:

  • Rate profiles honestly and in good faith based on genuine professional interactions.
  • Not submit false, retaliatory, or malicious ratings.
  • Understand that ratings represent subjective assessments and not verified facts.

DonnBoy reserves the right to remove ratings that appear fraudulent, retaliatory, or in violation of these Terms. We do not guarantee the accuracy or fairness of any rating or score displayed on the platform. Profile scores should not be relied upon as a substitute for your own due diligence as described in Section 4.

8. Payments and Transactions Between Users

DonnBoy does not process, facilitate, or intermediate any payments between Candidates and Viewers. Any financial arrangements, contracts, or transactions entered into between users are entirely private matters between those users.

DonnBoy expressly disclaims all responsibility for:

  • Any payment disputes between users.
  • Non-payment or late payment by a Viewer to a Candidate.
  • Fraudulent payment representations by any user.
  • The terms, enforceability, or outcome of any contract between users.
  • Financial losses of any kind arising from engagements arranged through the platform.

You are solely responsible for ensuring the legitimacy of any financial arrangement before proceeding. We strongly recommend that all professional engagements be documented in a written contract reviewed by a qualified legal professional.

9. Disclaimers and Limitation of Liability

9.1 Platform Disclaimer

THE APP AND ALL SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. DonnBoy EXPRESSLY DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF CONTENT.

9.2 No Liability for User Interactions

DonnBoy IS NOT LIABLE FOR ANY HARM, LOSS, INJURY, OR DAMAGE — WHETHER PHYSICAL, FINANCIAL, EMOTIONAL, REPUTATIONAL, OR OTHERWISE — ARISING FROM:

  • Any interaction, engagement, transaction, or relationship between users.
  • Reliance on any user profile, rating, report, or representation on the platform.
  • In-person meetings or communications arranged through the platform.
  • The conduct, actions, omissions, or misrepresentations of any user.
  • Failure by any user to perform due diligence before engaging another user.

9.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DonnBoy'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO DonnBoy IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR INR 1,000 (ONE THOUSAND RUPEES), WHICHEVER IS LOWER.

9.4 Indemnification

You agree to indemnify, defend, and hold harmless DonnBoy and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising out of or related to:

  • Your use of the App or Services.
  • Your violation of these Terms.
  • Your violation of any applicable law or third-party rights.
  • Any engagement or transaction you enter into with another user.
  • Content you upload to the platform.

10. Account Suspension and Termination

DonnBoy reserves the right to suspend, restrict, or permanently terminate your account at any time, with or without notice, for any of the following reasons:

  • Violation of any provision of these Terms.
  • Uploading inappropriate, illegal, or harmful content.
  • Engaging in abusive, fraudulent, or illegal behaviour toward other users.
  • Receiving multiple substantiated reports from other users.
  • Creating multiple accounts after a previous ban.
  • Any other conduct that we determine, in our sole discretion, to be harmful to the platform, other users, or DonnBoy.

Upon termination, your right to use the App immediately ceases. We may delete your account data in accordance with our Privacy Policy. You may not create a new account after termination without our express written permission.

You may request account deletion at any time by contacting us at the details provided in Section 14. We will process deletion requests within a reasonable timeframe.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts located in Moradabad, India.

Before initiating any legal proceedings, you agree to attempt to resolve any dispute through good-faith negotiation by contacting us at the details in Section 14. We will attempt to respond and resolve disputes within 30 days.

If you are located in a jurisdiction that requires disputes to be resolved through alternative dispute resolution mechanisms (such as arbitration or mediation), we reserve the right to invoke such mechanisms as permitted by law.

12. Push Notifications

By registering on DonnBoy, you consent to receiving push notifications related to your account activity, including new connection requests, accepted requests, messages, ratings, and profile views. You may withdraw consent for push notifications at any time through your device's notification settings. Note that withdrawing consent may result in you missing important activity on your account.

Your push notification token is stored on our servers and deleted when you log out of the App. We do not share your notification token with third parties other than service providers who enable push notification, which are used solely to deliver notifications to your device.

13. Miscellaneous

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DonnBoy with respect to your use of the App and supersede all prior agreements, understandings, or representations.

13.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

13.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by an authorised representative of DonnBoy to be effective.

13.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations freely without restriction.

13.5 Force Majeure

DonnBoy shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government actions, internet or telecommunications failures, or third-party service outages.
